If they had a condition and ignored the warnings, that's different.


But, please... be cautious how you speak of someone who suffered a major incident or has, perhaps, died.

We PassPorters are known for being kind and supportive, sensitive and empathetic. I would hate to see this thread devolve into name calling.

wow.. sorry i missed this thread.

1) well, you know the TOT thing.
2) re: mission:space, the lawsuit wasn't regarding the attraction itself, but the lack of immediate AEDs. the case was dismissed with prejudice with each side having to pay their own attorney fees.

Also, thanks for clearing up the M:S info -- the family was local to me, so it was on the news alot... but it's been so long, I was misremembering the legal details.

I did mean to add...

not only did Disney walk away unscathed from the M:S thing, but it wasn't until a man died on EE from heart failure much later that they agreed to start expanding the availability of AEDs at thrill attractions.

Regarding the lawsuits. Yes, things have gotten out of hand in this country but it is often not the individual who begins to pursue litigation. Often, the insurance companies insist that all roads have been taken to recover any money.

I was in an accident years ago (hit by an uninsured/unlicensed exchange student who then fled the country) and basically ended up suing myself - it was ridiculous. It wasn't something that I wanted to do but to get the insurance company to release the money to pay the hospital bills I had to go to court. It was a big waste of time and money but that is how the system works.

I know it is hard not to sometimes, but please don't pass judgment on someone for filing suit in any case unless you have personal knowledge of the circumstances. We all know how the news media can twist information.

My intention was not to offend. I was NOT judging. I was simply making the observation that society is over-litigious in general and it has caused many problems.
